Please send POLITE letters to the Prosecutor, thanking their office for rejecting Pre-Trial Intervention for this violent offender. Urge them to prosecute the case strongly and to recommend to the judge, maximum jail time and fines, mandatory counseling, and a prohibition from ever harboring or working with animals.<br><br><br><br>

Man charged with beating small dog rejected for PTI<br><br><br><br>

CAPE MAY COURT HOUSE The case of James P. Kelly IV, charged with animal cruelty in Ocean City, is still pending now that he has been rejected from the pretrial intervention program.<br><br><br><br>
Kelly, of Somers Point, was arrested after he allegedly beat a small dog and left it in a portable toilet in Ocean City on Feb. 3. The dog was so badly beaten it had to be put to sleep.<br><br><br><br>
Kelly had previously entered a not guilty plea and applied for the pretrial intervention program, a diversion program for first offenders that can last as many as 36 months.<br><br><br><br>
If a person completes the program, a conviction will not appear on his or her criminal record.<br><br><br><br>
His attorney, Jesse Deane, said Friday he had not decided whether he would appeal the rejection.<br><br><br><br>
Kelly's next court date is Aug. 3.
