"It was like I was too dumb to find a seat," Fuller said. Sawyer said fellow passengers snickered at the rhyme, which made her feel alienated.<br><br><br><br>
The sisters are seeking unspecified compensatory and punitive damages.<br><br><br><br>
U.S. District Judge Kathryn Vratil last week dismissed the sisters' claims of physical and emotional distress but set trial for March 4.<br><br><br><br>
"The court agrees with plaintiffs that because of its history, the phrase `eenie, meenie, minie, moe' could reasonably be viewed as objectively racist and offensive," Vratil wrote. The second line of a modern version of the rhyme usually goes, "Catch a tiger by the toe."<br><br><br><br>
Airline attorney John Cowden said there was no intent to discriminate against any passenger.<br><br><br><br>
Cundiff, who is white and was 22 at the time of the incident, said she had never heard the offensive version of the rhyme. She said she learned the Southwest version from co-workers and used it as a funny way of getting passengers who are not assigned seats on Southwest to sit down.<br><br><br><br>
Plaintiffs' attorney Scott Wissel said the sisters also want Southwest to stop using the rhyme and provide employee training to prevent such incidents.<br><br><br></div>

For what it is worth, I had never heard the "non-racist" version of the rhyme.<br><br><br><br>
I think this story says a lot about the world of 22 year-olds vs. the world of 40+ year olds--they live in two different worlds, for many practical purposes.<br><br><br><br>
I also think the sisters were reasonable to sue. I would have in their position.

Maybe it's different in the south but up here it's common to do that and say "catch a tiger by the toe." Simply means one is having trouble choosing and it's a way of picking at random. We did it all the time as kids.

I've heard both, and I remember in my elementary library, we had a little black sambo book. I really liked it, but didn't realise it was racist.

Here's the thing... the stewardess did not say anything racial whatsoever and has used this exact phrase several times before without incident. The phrase was said over the intercom and not directly at the two sisters. These two women "assumed" the stewardess was "really" meaning the racist version. Assumptions are not fact.<br><br><br><br>
This is more of a case of, "Oh, look, we can make some easy money here. Let's sue."<br><br><br><br>
This is a cash grab and should have been tossed for what it is... a couple of gold-diggers seeking some easy coin.

Actually suing over this is questionable at best. What has the world come to. Probably the same ***** that is suing McDonalds for being too large or spilled coffee in the drive up. What a crooked society we live in. You know better than that Joe!!

I never heard the racist version until I was an adult, so its possible that the flight attendant didnt know that the rhyme used to be racist. (Though one could argue that catching a tiger by the toe promotes animal cruelty. <img alt="" class="inlineimg" src="/images/smilies/tongue3.gif" style="border:0px solid;" title=":p">)<br><br><br><br>
Regarding the hot coffee lawsuit, once I learned the details about the case I concluded that the woman was right to sue.<br><br>

Thanks for educating me guys...What about the other lawsuit, I don't know a lot about it, but it makes me wonder. Apparently Michael is not very impressed and he usually has a pretty good bearing on what the hell's going on?

The lady put the coffee between her knees and spilled it while prying the lid off. <img alt="" class="inlineimg" src="/images/smilies/rolleyes.gif" style="border:0px solid;" title=":rolleyes:"><br><br><br><br>

My only question is....Didn't she have it sitting between her legs and spilled it by prying the lid off. Even though the coffee was hot, wtf? Isn't that a user error. And making millions of that is indeed absurd??<br><br><br><br>
The "*****" coulda dunn it on purpose...That's all I'm saying.

Hehe, that's nearly as ridiculous as if she sued the auto maker for not providing a coffee cup holder as standard equipment so that passengers can safely open coffee lids without fear or spilling hot liquids onto themselves. That is no more ludicrous than blaming someone for her inability to remove a lid without spilling it on herself.

Right, another ridiculous suggestion, but equally as ridiculous as the suit itself and with just as much merit. Still blaming someone else for their own actions.

we can all espouse opinions until the cows come home, but the bottom line here is, you live in a society with a judicial system that allows people to bring grievances before a judge, and seek damages for them, period.<br><br><br><br>
i personally don't ever want that to change, no matter how frivilous we deem these matters.

Oh, I would love to see it changed.<br><br><br><br>
I'd like to see it changed where the plaintiffs and their ambulance-chasing attorneys are fined a significant sum for bringing frivolous suits in the first place.
