If I plan to kill you and do it (purely hypothetical, no need to crawl up in a corner and cry then report it as a threat, I DO NOT HAVE ANY REASON TO COMMIT SUCH AN ACTION) anyway, I plan, I kill. In this case I have perceived you doing something so wrong to me that I talked myself into retaliation, and planned it. in other words, in my mind I had justification for the kill.
but a lessor charge would be if I just walked up in the street and shot you because,, Well, because you were there, Ive never met you, you have never wronged me, and I have no reason to hold anything against you.. yet, I walk up and kill you.
To me, the second is more of a threat to society, and because of that I think that it should have the harsher punishment.
