I'm so happy the DA is prosecuting them and not backing down, he's not on the cops side, it's a nice change.

Santa Ana, California (CNN) -- A Fullerton police officer pleaded not guilty Wednesday to charges of involuntary manslaughter and felony use of excessive force in the beating death of a mentally ill homeless man who died after a police arrest.

Cpl. Jay Patrick Cicinelli was released Wednesday on $25,000 bail, according to his attorney and a spokeswoman for the prosecutor.

Meanwhile, the arraignment of the officer facing more serious charges, Manuel Anthony Ramos, was continued to September 26 at the request of his attorneys. Ramos was being held Wednesday after Orange County Superior Court Judge Erick L. Larsh set his bail at $1 million.

What I can't understand is why Ramos is not being charged with first-degree murder. Why only second-degree?

Q: How many poets does it take to change a light bulb? A: 1001...one to change the bulb, 1000 to say it's already been done.

I guess this would be the wrong place to suggest that if found guilty of murder, the Police involved should also be sent to the chamber?
Police should be held above others as far as safety and standards go, if they are caught killing without cause, then I have no other option but to subject them to the same that I would subject a cop killer to.
sounds like a death penalty situation if one was to ask me.

I agree they should not be given preferential treatment because they are cops. Personally I believe no one should be given the death penalty.

Because there was no plan to carry it out, it was in the moment which is what second degree is, which is fine to me as long as the charges are not brought down. That's what they usually do to people is give them a huge charge because they might plead down, and often it's extremely ridiculous, like someone was charged with first degree murder for what amounts to manslaughter. The DA swore he would not be lowering the charges, he would also have to accept or reject any plea agreement, so i'm assuming he would reject any that would give him a lesser charge.

I have never really understood that.
If I plan to kill you and do it (purely hypothetical, no need to crawl up in a corner and cry then report it as a threat, I DO NOT HAVE ANY REASON TO COMMIT SUCH AN ACTION) anyway, I plan, I kill. In this case I have perceived you doing something so wrong to me that I talked myself into retaliation, and planned it. in other words, in my mind I had justification for the kill.
but a lessor charge would be if I just walked up in the street and shot you because,, Well, because you were there, Ive never met you, you have never wronged me, and I have no reason to hold anything against you.. yet, I walk up and kill you.

To me, the second is more of a threat to society, and because of that I think that it should have the harsher punishment.
