Maybe I'm just being ignorant, but I don't understand this statement:

But by entering the farm, the activists risked infecting the hens with diseases, Kehoe said yesterday, noting they could have caused “death [of hens] on a mammoth scale” and enormous economic damage to both Wegmans and the community.

If the activists had truly cared about the hens, Kehoe said, they would have contacted the authorities. Instead, they chose to attack Wegmans through their film, he said.

First of all, is there really a danger that people entering the henhouse could cause a huge amount of illness? If so, how do they get the eggs out? And furthermore, isn't that in itself a commentary on the conditions these hens are kept in, if they're so unhealthy that any contact with a person could kill them?

And secondly, the activists wouldn't have had any evidence to present to the authorities if they hadn't "illegally" gone in in the first place. Kind of a Catch-22 isn't it?

Yes. From what I hear, the hens are kept in such horrible conditions, and so hepped up on antibiotics and other drugs that they're barely hanging onto life anyway. It wouldn't take much of a germ to cause a massive outbreak. I hear the owners tend to keep access strictly controlled for this reason.

And furthermore, isn't that in itself a commentary on the conditions these hens are kept in, if they're so unhealthy that any contact with a person could kill them?
Yes, it certainly is. :(

but when the authorities did go in, they did nothing. what's allowed by law is the standard condition that egg-laying hens are raised in -that actually forms the law, the "standard conditions" - which is cruel by any welfare standards. the activists realized that as far as farm animals go, the laws are minimal to nonexistant.

Testifying during his trial, Durand said the activists removed the hens because they wanted to help them. He described hens covered in flies, trapped in manure pits and hens with their necks stuck in cages.

this condition of hens starving and dying in manure pits is not against the law on an egg farm.

its preatty messed up when the conditions those hens are and were kept in is considered o.k. by those in authority. In some states Texas for one just filming or taking pictures on a ranch or egg farm will get you in trouble with the law you don't even have to tresspass.

I understand it is rare to give the maximum sentence on first time misdemenor trespassing charges but I imagine it is rare for the defendent to stuppornly defend their actions and show no remorse.

Conveyor belts underneath the rows of battery cages. Food and water is delivered mechanically, also. It's a far more biologically dangerous environment to healthy people entering, though, than the alleged "biosecurity" risk to the captive hens.
And furthermore, isn't that in itself a commentary on the conditions these hens are kept in, if they're so unhealthy that any contact with a person could kill them?
Yes indeedy.
Forgot to add--if you would like to send letters of encouragement and support to Adam, this looks to be the address:

I'd bet $10 that for every person sentenced the maximum for a stupid misdemeanor 100 wife beaters, DIUs, child abusers, rapists, etc don't serve their full time because there isn't enough room.

This judge must like eggs alot.

Soon it will be a crime to take photos.

They will put more and more and more pressure on ANYONE who dares speak up against the animal industry.

Once they have put the gentle non-violent activists into prison, all that will be left will be the extremists and amongst those will be some who do not respect the ALF credo of not harming sentient beings. And also what will be left are some very angry non-violent activists who just may decide that non-violence is no longer the way to go.

They are treading on dangerous ground here (the authorities). But I think they are unable to look at the long-term consequences of their actions. All they care about is supporting the short-term profits from animal exploitation.

I'll write to this brave man. And I think it's really time for me to order that t-shirt that says "All my heros have FBI files".

This is the part that ticked me off:

"He asked Kehoe to give Durand time to make arrangements for his pets before beginning his sentence, but the judge declined, he said"

Okay - so I guess the thing we can establish is that the judge is an animal hater (or at the very least - NOT an animal lover!)!

I agree - the guy broke the law and deserved to be "punished" for it (since it is the law), but c'mon! Geesh!

"A jury acquitted Durand of felony burglary and petty larceny charges"

It could have been much worse.

If he didn't think that tresspassing on an egg farm and taking chickens and then releasing a video about it wasn't going to land him in some trouble, he should have thought more.

Not that I'm against what he did.
